Zephyrus Terms and Conditions

1. Agreement

By selecting the agreement checkbox and creating an account, or by continuing to use Zephyrus, you confirm that you have read and agree to these terms. If you do not agree, do not create an account or use the applications.

Nothing in these terms limits rights that cannot lawfully be excluded, including rights under applicable consumer-protection law.

2. Important definitions

Zephyrus Adult Account Applications

This means application content made available to an account whose recorded age is 18 or over. It may contain adult conceptual information concerning cognition, identity, behaviour or wellbeing. Because that material may be confusing, distressing or otherwise damaging to the wellbeing of a child, adult users are advised not to discuss or share it with anyone under 18. Adult access does not mean that every item is unsuitable for younger people; it means the adult account holder must use careful judgement and protect children from material they may not be ready to understand.

Susceptibility Self-Determination

This means your continuing responsibility to notice and decide how your personal sensitivities, health circumstances, emotional responses and other susceptibilities affect your use of Zephyrus. You may experience useful reflective or recovery-related effects while a susceptibility simultaneously complicates or worsens your experience. You should pause or stop using an application if content causes distress, confusion, fixation, worsening symptoms or another adverse effect. Zephyrus does not guarantee improvement in wellbeing. Anyone experiencing persistent or long-term mental-health complications should discuss their condition and use of cognitive-health tools with a doctor or other appropriately qualified healthcare professional.

GP Recommendation Is Advised

This means that Zephyrus recommends speaking with a general practitioner before relying on or making significant decisions from application content, especially if you have a diagnosed or suspected mental-health disorder, learning disability, cognitive impairment, are receiving treatment, or are concerned about changes in your wellbeing. A GP can consider your individual circumstances and direct you to suitable clinical or specialist support. This recommendation is not itself medical advice.

3. Health and safety boundaries

Zephyrus is intended for cognitive-health reflection, education and proactive wellbeing support. Unless a particular product expressly says otherwise and carries the required regulatory status, it is not a medical device or healthcare provider and is not intended to diagnose, prevent, monitor, predict, treat or cure any disease, disorder or disability.

Application outputs are informational and may be incomplete, unsuitable or incorrect for your circumstances. They are not a clinical assessment, diagnosis, prescription, treatment plan or substitute for professional judgement. Do not start, stop or change medication, therapy, care or safeguarding arrangements because of Zephyrus content.

If you need urgent mental-health help in the UK, contact NHS 111 or request an urgent GP appointment. If life is at risk or you cannot keep yourself or another person safe, call 999 or go to A&E. Users outside the UK should contact their local emergency or crisis service.

4. Accounts, age and security

You must provide accurate registration information, including your date of birth, and keep your password confidential. You are responsible for activity carried out through your account unless it results from a security failure for which Zephyrus is responsible.

You must be legally capable of agreeing to these terms. A person under 13 must not create an account without the involvement and valid authorisation of a parent or person with parental responsibility. Additional age rules may apply where you live. Users under 18 must use only content made available for their age and should involve a trusted adult or qualified professional when content raises wellbeing concerns.

Do not misstate your age to obtain adult application content or permit another person to use your account to avoid an age restriction.

5. Licence and acceptable use

Zephyrus grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use the website and applications as a means of accessing their intended functionality, subject to these terms.

You must not misuse the service, attempt unauthorised access, interfere with security or availability, introduce malicious code, scrape or reproduce protected content at scale, reverse engineer software except where law expressly permits it, impersonate another person, or use Zephyrus to harm, exploit or unlawfully discriminate against anyone.

Application content, branding, software and visual assets remain owned by Zephyrus or the relevant rights holder. No intellectual-property rights are transferred to you.

6. Purchases and consumer rights

Any price, payment schedule, renewal arrangement, cancellation right and product-specific condition shown at checkout forms part of your agreement. You must provide accurate payment information and have authority to use the selected payment method.

Digital content and services must conform to the contract, be of satisfactory quality and be suitable as a means of meeting a disclosed requirement where applicable law requires this. These terms do not remove statutory remedies, cancellation rights or refund rights that apply to you.

7. Account information

Zephyrus processes registration, profile, security and application-use information as needed to provide accounts, protect the service, support users and meet legal obligations. Health-related or inferred cognitive information can be particularly sensitive. Do not enter information that an application does not request, and do not submit another person's confidential information without a lawful reason and appropriate permission.

You may request account deletion through the account page. Some information may need to be retained where required by law, to resolve transactions or disputes, or to protect the service. Contact Zephyrus before registering if you need more information about how your data will be handled.

8. Availability and application changes

Zephyrus may maintain, secure, improve, replace or discontinue features. Continuous or error-free availability is not promised. Reasonable care will be taken when changes materially affect a paid service, subject to legal rights and events outside reasonable control.

Terminology and translation accuracy

Zephyrus applications present interpretations of conceptual translations. Their terms, labels, symmetric relationships and advice-like guidance communicate those interpretations; they do not establish final or objectively complete definitions. Terminology may be incomplete, ambiguous, culturally variable or capable of a more accurate interpretation.

Symmetric translations are theoretically not finalisable. In these terms, not finalisable means that translating a concept between corresponding terms, positions, cultures or application structures may always permit further refinement. No translation can be guaranteed to be the uniquely complete or final expression of the underlying concept.

Application content is therefore subject to correction, reinterpretation and change as Zephyrus develops its terminology and translation methods. Users should not treat a translation as established fact or professional advice, or rely on it as the sole basis for a significant decision.

Freedom of belief, interpretation and expression

Religious, philosophical and conceptual translations may constitute protected expression. Where an interpretation manifests a qualifying religion or belief, its creation, teaching and dissemination may also engage freedom of thought, conscience and religion. In the United Kingdom these interests may fall within Articles 9 and 10 of the European Convention on Human Rights as given effect by the Human Rights Act 1998. They include the freedom to hold opinions, receive and impart information and ideas, and manifest religion or belief through teaching, practice and observance.

These protections are qualified and do not give Zephyrus, its applications or any interpretation automatic immunity from legal proceedings or generally applicable law. A restriction may be lawful where it is prescribed by law and is necessary and proportionate to protect public safety, public order, health or morals, or the rights, freedoms and reputations of others. Human-rights protections do not excuse unsafe content, unlawful discrimination, defamation, infringement of intellectual-property rights, misleading commercial claims or breach of mandatory consumer protections.

The right to education principally regulates education systems and teaching functions assumed by the State. It does not by itself make a private application immune from regulation or legal claims. Religious and philosophical convictions may nevertheless be relevant when a public authority or court assesses expression, teaching and the proportionality of a restriction.

You are responsible for maintaining compatible equipment, internet access and reasonable backups of information you choose to retain.

9. Responsibility and liability

You remain responsible for decisions you make after using Zephyrus, including deciding when to stop and seek professional help. Zephyrus is responsible for loss that is a foreseeable result of breaching these terms or failing to use reasonable care and skill, subject to applicable law.

Zephyrus does not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of mandatory consumer rights. Nothing in these terms requires you to accept an unfair exclusion of liability.

Subject to those protections, Zephyrus is not responsible for how a user chooses to apply information from an application, or for consequences of treating an interpretive translation as a final definition, established fact or professional advice.

Zephyrus is not responsible for loss caused by inaccurate information you provide, use contrary to warnings or professional advice, unauthorised third-party access caused by your failure to protect credentials, or external services outside Zephyrus's reasonable control, except where the law provides otherwise.

10. Suspension, termination and changes

You may stop using Zephyrus and may request account deletion. Zephyrus may restrict or end access where reasonably necessary to address serious misuse, security risk, legal obligations or material breach of these terms. Where appropriate, notice and an opportunity to resolve the issue will be provided.

These terms may be updated for legal, safety, security, product or operational reasons. Material changes will be presented clearly and, where required, acceptance will be requested before continued account use. The effective date at the top identifies the current version.

11. Governing law and contact

These terms are governed by the laws of England and Wales, without removing any mandatory protection available under the law where you live. Consumers may bring proceedings in any court available to them under applicable law.

If legal action alleges that Zephyrus interpretations amount to inappropriate education, Zephyrus will assess the allegation under the applicable law and evidence. Where an act of a public authority, or a remedy sought through a court, would unjustifiably restrict protected religious or philosophical manifestation or freedom of expression, Zephyrus may rely on applicable human-rights protections and challenge the act or remedy as unlawful or disproportionate. Legal action will not be treated automatically as a human-rights breach merely because it concerns religious, philosophical or conceptual interpretation.
